1. Nature of our services

The Nannies Place acts only as an introduction and recruitment agency.

  • We introduce Candidates to Clients (families and households) for potential employment.
  • We do not employ the Candidates. Unless clearly stated otherwise in writing, the Client is the employer of the Candidate.
  • The Client is responsible for agreeing contract terms directly with the Candidate and for complying with all legal obligations related to the employment relationship.

2. No legal, tax or immigration advice

The information on this website is provided for general information purposes only. It does not constitute:

  • legal advice,
  • tax or social security advice, or
  • immigration / visa advice.

Employment, tax and immigration rules can be complex and may change. Clients and Candidates should seek independent professional advice from qualified lawyers, tax advisers or immigration specialists in the relevant country before making decisions.

3. Client responsibilities (Spain and other countries)

When hiring a Candidate, the Client is solely responsible for:

  • Complying with applicable employment laws (for example, working hours, salary, holidays, termination, and social security contributions).
  • Registering as an employer, where required, with the relevant authorities (for example, in Spain with Social Security and, if applicable, the Tax Agency).
  • Ensuring the Candidate has the right to work in the country of employment (visas, residence and work permits).
  • Providing a written employment contract that complies with the law of the country where the work takes place.
  • Ensuring a safe working and living environment, especially where the Candidate is a live‑in nanny.

The Nannies Place is not responsible for any failure by the Client to meet these obligations.

4. Candidate checks and limitations

The Nannies Place may carry out reasonable checks on Candidates (for example, reference checks, CV review, and where possible, verification of qualifications or background information). However:

  • We cannot guarantee that all information provided by Candidates or referees is complete, accurate or up to date.
  • The final decision to hire a Candidate is taken solely by the Client, who should carry out any additional checks they consider necessary (for example, criminal record checks, local police certificates or medical checks, where legally permitted).

The Nannies Place is not liable for any loss, damage or problems arising from the acts or omissions of a Candidate before, during or after their engagement by the Client.

5. Limitation of liability

To the maximum extent permitted by Spanish law:

  • The Nannies Place shall not be liable for any indirect, consequential or special loss, including loss of earnings, loss of opportunity or reputational damage.
  • Our total liability to any Client in relation to our introduction services shall not exceed the placement fee actually paid by that Client to The Nannies Place for the relevant placement.

Nothing in this notice excludes or limits liability where such exclusion or limitation is prohibited by law.

6. Data protection

The Nannies Place processes personal data of Clients and Candidates in accordance with:

  • Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR), and
  • Spanish Organic Law 3/2018 (LOPDGDD) and related implementing rules.

Personal data is processed only for legitimate recruitment and placement purposes, such as:

  • assessing Candidates and matching them to Client requirements;
  • communicating with Clients and Candidates;
  • complying with legal obligations (for example, accounting and record‑keeping).
