TERMS AND CONDITIONS

1. Introduction

These Terms and Conditions govern the recruitment and placement services provided by The Nannies Place ("the Agency") to the Client. By engaging the Agency, the Client agrees to be bound by these Terms.

2. Definitions

  • Candidate – Any nanny, maternity nurse, housekeeper, mother's help, au pair, or other childcare professional introduced by the Agency.
  • Client – The individual, family, company, or authorised representative engaging the Agency's services.
  • Placement Fee – The fee payable upon successful engagement of a Candidate.

3. Fees

Registration fee (non-refundable) £70

Service Fee Permanent live-in or live-out nanny 8% of gross annual salary

Permanent live-in couple 8% of each employee's gross annual salary

Permanent au pair 17% of gross annual salary

Maternity nurse£700 per two-week booking

Temporary placement – 1 month £500 T

Temporary placement – 2 months £700

Temporary placement  3 months £900

Temporary placement – each additional week £100

All fees are quoted in GBP (£) and exclude any applicable taxes.

4. Trial Period

A complimentary three-day trial is included. Extensions beyond three days are charged at £35 per week unless otherwise agreed in writing.

5. Payment Terms

The placement fee becomes due upon signature of this agreement. Payment must be received within seven (7) days of invoice or before the Candidate's start date, whichever is earlier.

Late payments may incur interest at 5% above the Bank of England base rate, calculated daily from the due date until payment is received in full.

6. Confidentiality

All Candidate information is confidential and must not be shared with third parties without the Agency's prior written consent.

7. Client Responsibilities

The Agency acts solely as an introduction service. The Client is fully responsible for:

  • Compliance with employment law in their jurisdiction
  • Safeguarding and welfare obligations
  • Tax, National Insurance, and social-security contributions
  • Immigration status, visas, and right-to-work checks
  • All other obligations arising from the employment relationship

8. Data Protection

Both parties shall comply with:

  • Regulation (EU) 2016/679 (GDPR)
  • Spanish Organic Law 3/2018 (LOPDGDD)
  • UK Data Protection Act 2018 (where applicable)

Personal data will be processed only for lawful recruitment purposes, on an appropriate legal basis, and with suitable security measures. The Agency's Privacy Policy is available on request.

9. Replacement Guarantee

If a permanent placement ends within four (4) months for any reason other than redundancy, the Agency will use reasonable efforts to provide one replacement Candidate at no additional placement fee, provided all fees have been paid in full. No cash refunds are offered.

10. Limitation of Liability

The Agency does not guarantee a Candidate's future performance, conduct, or continued availability. The Agency shall not be liable for any loss, damage, or claim arising from the Client's employment decisions or the Candidate's actions.

11. Governing Law and Jurisdiction

This Agreement is governed by the laws of Spain. Any dispute shall be subject to the exclusive jurisdiction of the Courts of Valencia, Spain.

12. Entire Agreement

These Terms constitute the entire agreement between the parties. Amendments must be agreed in writing and signed by both parties.
